  1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, “General Conditions”) govern the purchase of products and services, carried out remotely via the internet, from the site www.museotriora.it (hereinafter, the Site) in accordance with Italian law as per Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”). The seller is the Associazione Turistica Pro Triora with head office in Corso Italia 3 – 18010 Triora (IM). Tax code: 81013500087 – VAT number: 00991740085. Mail: protriora@museotriora.it – REA IM 85570 The user of the site who intends to purchase (hereinafter the “Customer”) is obliged, prior to the confirmation of the order, to read carefully these General Conditions which have been published on the Site.

  1. Choosing and buying products

The characteristics and price of the various products/services on sale on the Site (hereinafter the “Product” or “Products”) are shown on the page relating to each Product with a specific “Product Sheet”. The Customer shall add the Product(s) to the “Shopping Cart” and, after having read the General Terms and Conditions and the Privacy Policy and confirmed their acceptance with a flag in the appropriate field, shall enter the shipping details, select the desired payment method and confirm the order. By sending the order from the Site, which has the value of a contractual agreement, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure, that he/she has read the technical data sheet and understood the characteristics of the Products and that he/she fully accepts these General Conditions and those of the selected payment method. The contract stipulated with the Customer shall be considered concluded with the acceptance of the order. Such acceptance shall be communicated to the Customer by means of an email confirming the order itself to the email address entered by the user during the order confirmation phase. This email shall contain the order number, the shipping data, the list of Products ordered and the total price and the costs of any delivery. The Customer will check the confirmation email and, if he/she identifies any errors in the order, he/she will have 24 hours from receipt of that email to change the order directly online or to contact us (protriora@museotriora.it).  

  1. Product Information

Information and characteristics relating to the Products are available on the Site. All information on the Products is provided in Italian, French and English.  

  1. Prices and shipping

The prices of the products include all taxes and duties. All prices are in Euro.

  1. Methods of payment and invoicing

The Customer may pay the price of the Products and the relative delivery costs by credit card and PayPal. PayPal Once the order has been confirmed, the Customer will be redirected to the PayPal website where he/she can make the payment using his/her account or using a card, even a prepaid card, or in any case according to the methods accepted by PayPal and in compliance with its conditions.  

  1. Transport and delivery

The Products purchased on the Website will be delivered to the address indicated by the Customer during the purchase procedure in the “Shipping Data” field. In any case, except for reasons of force majeure or unforeseeable circumstances, the Products ordered will be delivered within a period of 7 (seven) working days from the day after the order is confirmed to the Customer by means of an order confirmation email. The aforementioned term of 7 working days applies to shipments within Italy.

  1. Right of withdrawal

As provided for by the Consumer Code D.LGS 206/05 (former Right of Withdrawal) and Legislative Decree 21/2014, Customers have the possibility to return purchased products within 14 working days from receipt. The procedure for the exercise of the Right of Withdrawal provides for a communication from the Customer which must be sent by registered letter with return receipt, addressed to: Associazione Turistica Pro Triora, Corso Italia 3 – 18010 Triora (IM), which will provide, once received the communication, to open a file for the management of the return and to communicate to the Customer the instructions on how to return the Products.   The right of withdrawal is governed by the following conditions: If the right of withdrawal is exercised, Pro Triora will refund the customer the full amount paid to purchase the goods subsequently returned, including shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to Pro Triora’s right to suspend payment of the refund until the actual receipt of the goods. The refund will be made using the same method of payment used by the customer, unless the latter has expressly requested a different method of credit. In case of bank transfer, the Customer shall provide the bank details to obtain the refund (account holder, name and address of the Bank and IBAN). Also in order to guarantee that the return is free of charge, the Products must be returned in the same type of packaging in which they were received.

  1. Errors and limitations of liability

The information relating to the Products provided through the Site is constantly updated. It is not possible, however, to guarantee the complete absence of errors for which Pro Triora cannot be held responsible, except in cases of fraud or gross negligence. Pro Triora reserves the right to correct errors, inaccuracies or omissions even after an order has been placed, or to change or update the information at any time without prior notice, without prejudice to the rights of the customer under these Terms and Conditions and the Consumer Code.

 

Pursuant to Article 1341 of the Civil Code, the Customer declares to have read and accepted all the articles

The Customer shall add the Service to the “Shopping Cart” and, after having read the General Terms and Conditions and the Privacy Policy and confirmed their acceptance with a flag in the appropriate field, shall enter the billing information, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual agreement, the Customer acknowledges and declares that he/she has read all the information provided to him/her during the purchase procedure, that he/she has read and understood the characteristics of the Services and that he/she fully accepts these General Conditions and those of the selected payment method.
